    … those days when things are going good, but still it doesn’t seem that way. Eric and I headed out to Watson Lake this afternoon and I think the high was around 43F and a pretty good breeze on the lake. The water is very low, but the launch on the improved ramp went without an issue. We decided to do all electric today primarily because of the low water level and number of rocks just inches below the surface. For whatever reason the waterfowl spooked early and it was tough to get anywhere close to them and the wind when I was trying to maneuver close to the rocks to get shots of herons and such led to verbal attempts to warm the atmospheric temperature as steerage with the electric motor on a low setting and the wind was very difficult and I missed shot after shot trying to stay off rocks, grab a camera and shoot a departing bird … something better will be devised.

    I got this shot of an American Merganser and it was one of many good shots. We got off the lake at sunset and home well after dark, cold …. Brrr!

    Cold and snowy on New Years Eve, so it will be an indoor day working on photos and closing out projects for the year. Methinks a very good year is coming up in 2019.

    Back later tonight, first some rest, then espresso and the day to be lived. Currently brewing Pure Kona espresso over a small scoop of vanilla ice cream in the cup … talk about an unbelievable treat!!!

    Have a beautiful day … do not make any resolutions … prepare to live the best year ever … you are still here, how can it get any better than that?

    Analyzing City’s Legal Right to
    Ban OHVs on Public Roads

    Mea Culpa! Mea Culpa! Mea Maxima Culpa! I screwed up. Blew it. Totally made a fool of myself. Missed the boat. I am talking about my editorial on the OHV fight, No Legal Traction on OHVs. I assumed that it was ADOT that would make a decision on whether the city could legally ban off road vehicles from our public roads like S.R. 89A and S.R. 179. Man was I off. ADOT has nothing to do with allowing or disallowing the city to do so. ADOT’s response to me when I asked them to clarify their position, was curt and to the point. “ADOT designs, builds and maintains the state highway system,” I was told. “It is not our place to offer an opinion on how state law might apply in this matter.” It was a totally “duh” moment for me when I realized that that the decision or judgement on the OHV ordinance, would involve the state and not ADOT. Chagrinned I stand. The crux of the matter then is whether the city can effectively use a number of standing state laws that can be interpreted to determine whether the city can legally ban the vehicles or not.
