    Seeking to Identify Auto Theft Suspect from
    Rimrock incident

    logo_ycsoRimrock AZ (August 20, 2019) – On August 18, 2019, at approximately 3:45 PM, Yavapai County Sheriff’s Office deputies were dispatched to the McGuireville Mini Mart in the 2100 block of E Beaver Creek Rd, Rimrock, regarding an auto theft. The victim told deputies that while he was inside the mini-mart for just a couple of minutes, his gold 2003 Toyota Tacoma ½ ton pick-up was stolen. The stolen truck was last seen driving towards Rimrock. The vehicle license plate was entered into a national law enforcement database. 

    Just after 9 PM, the reporting deputy was contacted by officers from the Gallop Police Department in New Mexico. Their officers had located and stopped the vehicle. The suspect driver ran from officers and was not caught. The vehicle was recovered.

    Deputies were able to locate video of the suspect who was in the mini-mart earlier in the day and 2 photos from the video are attached. The suspect is described as a Native American or Hispanic male, 5’10” in height, 160 lbs., black hair, brown eyes, and last wearing a black T-shirt, blue jeans, and a blue hat. In the video, the suspect is seen standing just outside the doorway and approached the vehicle as soon as the victim enters the store – an apparent crime of opportunity. *

    Deputies are encouraging anyone with information on the suspect to contact YCSO at 928-771-3270 or report a tip anonymously to Yavapai Silent Witness at 1800-932-3232. Online tips may be reported at www.yavapaisw.com. If a direct tip to Silent Witness leads to the arrest of this suspect, a cash reward will be offered. 

    *Note – it goes without saying, but needs repeating – Never leave the car keys in your unattended and unlocked vehicle. Be aware of your surroundings as you never know who is watching.

    Analyzing City’s Legal Right to
    Ban OHVs on Public Roads

    Mea Culpa! Mea Culpa! Mea Maxima Culpa! I screwed up. Blew it. Totally made a fool of myself. Missed the boat. I am talking about my editorial on the OHV fight, No Legal Traction on OHVs. I assumed that it was ADOT that would make a decision on whether the city could legally ban off road vehicles from our public roads like S.R. 89A and S.R. 179. Man was I off. ADOT has nothing to do with allowing or disallowing the city to do so. ADOT’s response to me when I asked them to clarify their position, was curt and to the point. “ADOT designs, builds and maintains the state highway system,” I was told. “It is not our place to offer an opinion on how state law might apply in this matter.” It was a totally “duh” moment for me when I realized that that the decision or judgement on the OHV ordinance, would involve the state and not ADOT. Chagrinned I stand. The crux of the matter then is whether the city can effectively use a number of standing state laws that can be interpreted to determine whether the city can legally ban the vehicles or not.
