… once in a while when I am in the Lake Pleasant area it is fun to drive in the back country west and north of the lake in search of Wild Burros and more often than not I find them. I found a group of them near the old “Turf North” runway … when flying sailplanes out of Turf Soaring, it used to be a small landable forest service strip several miles north of Lake Pleasant. It was a great place to have there in case you got hammered and were unable to make it north across the Bradshaw’s or south across the lake and back to Pleasant Valley Airport where Turf was located. Turf is gone and so is Turf North … but the Burros are still there and life continues. Wild horses and burros are available for adoption through the BLM if you are interested and there are numerous sales throughout the year, including several in Arizona. Check the website out at: https://www.blm.gov/adoptahorse/index.php and/orhttps://aci.az.gov/adopt-a-horse-or-burro/ .

A great weekend with mostly a lot of work on the book and it is going well … still looking at an April publish date.

A new week is already well underway and I’m due for infusions of espresso in not that many hours. Have a beautiful day … smile, we are here and that is the start of the best day of your life! Your choices today determine how you will view the day tonight.

    Cheers

    Ted

    Analyzing City’s Legal Right to
    Ban OHVs on Public Roads

    By Tommy Acosta
Mea Culpa! Mea Culpa! Mea Maxima Culpa! I screwed up. Blew it. Totally made a fool of myself. Missed the boat. I am talking about my editorial on the OHV fight, No Legal Traction on OHVs. I assumed that it was ADOT that would make a decision on whether the city could legally ban off road vehicles from our public roads like S.R. 89A and S.R. 179. Man was I off. ADOT has nothing to do with allowing or disallowing the city to do so. ADOT’s response to me when I asked them to clarify their position, was curt and to the point. “ADOT designs, builds and maintains the state highway system,” I was told. “It is not our place to offer an opinion on how state law might apply in this matter.” It was a totally “duh” moment for me when I realized that that the decision or judgement on the OHV ordinance, would involve the state and not ADOT. Chagrinned I stand. The crux of the matter then is whether the city can effectively use a number of standing state laws that can be interpreted to determine whether the city can legally ban the vehicles or not.
