Trump is making a really big mistake vilafying individual judges and the judicial system itself, and it’s going to backfire on him.
First, his use of the Alien Enemies act of 1788 as an excuse to deport immigrants suspected of criminal ties to jails known for human cruelty and atrocities without vetting them or proving they are guilty is moot because there is no war with Venezuela or the Tren de Aragua gang.
There is no proof anywhere that there is an invasion going on. No gun fights. No bombs being dropped. No pitched battles. No unfirmed members of the gang taking by force cities and communities on the east or west coasts and in middle America.
Where is the war? Can he declare war on a gang? Is it only up to congress to declare a war?
According to Wikipedia, the Constitution grants Congress the sole power to declare war. Congress has declared war on 11 occasions, including its first declaration of war with Great Britain in 1812. Congress approved its last formal declaration of war during World War II.
Can Trump get Congress to declare war on Tren de Aragua?
Yes. There are killings, rapes and murders attributed to that gang but there is no physical proof of an armed incursion into the states that could by any stretch of the imagination be called a war.
Agreed, the guilty scum that have created crimes in our country should be shipped out of America ASAP and jailed for life but the Supreme Court, will look at Trump’s appeal to continue with the deportation under the act, and rule that there is no war and therefore he cannot use the act to deport the guilty or not guilty Venezuelans out of the country.
He will just have to find another way to do it and we can be sure he will.
But there is a deeper conflict going on that supersedes the question of what law or manner could be used to rid the country of the gangs — and that is the coming brawl between the judiciary and executive branches of our government.
You can bet your bippy that judges across the country, including SCOTUS, are going to stick together on this one because they can see that the executive branch is getting ready for a power grab by the Trump administration and they are not going to sit idly by while the executive branch exerts its dominance and takes over the three branches of government, once and for all.
We can expect the Supreme Court to toss the case back to the original judge who stopped Trump, allowing him to rule as he sees fit.
Or, SCOTUS tells Trump to shove it and go find another way to get rid of the illegal immigrants.
There ae also financial considerations as well as the Trump admiration made a deal with the government of El Salvador to send the deported to Cecot, El Salvador’s notorious “Terrorism Confinement Centre” – a maximum-security prison built to house violent members of the MS-13 and 18th Street gangs, paying $20 million for the approximate 250 immigrants who were sent there before the judge’s order stopped the deportations.
That’s about $24,000 per prisoner, so far.
The question arises what will Trump do if SCOTUS sides with U.S. District Judge James E. Boasberg, and the president’s plan to deport suspects to El Salvador is thwarted?
Will he simply claim that the courts are wrong, and he would do what is necessary to protect America against an invading force?
Will the American public back Trump no matter what, and agree he has the right to supersede the courts to save our country?
We will see. The good money is Trump will back down and just find another way to deport them, not necessarily to the El Salvador jail, and just send the suspect immigrants back to Venezuela regardless of their suspected criminal affiliations.
